These Terms and Conditions govern your use of the Meylt website and the purchase of products from Meylt.

By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.

Throughout these Terms and Conditions, "Meylt", "we", "our" and "us" refer to AndAmpersand Ltd.

"Customer", "you" and "your" refer to any person using the website or purchasing products from us.

2. Website use

You agree to use the website only for lawful purposes.

You must not:

misuse or interfere with the website;
attempt unauthorised access to systems or data;
introduce malicious software;
use the website in a way that may damage its operation or reputation.

We reserve the right to suspend or terminate access where we reasonably believe these Terms have been breached.

3. Products

Meylt offers made-to-order fine art prints and related products.

Products displayed on the website are subject to availability.

We reserve the right to:

withdraw products at any time;
amend product descriptions;
correct errors in pricing, descriptions or specifications;
refuse or cancel orders where necessary.

Images displayed on screen are intended as representations only. Colours and appearance may vary between devices and the final printed product.

4. Orders

An order is placed when you complete checkout and receive an order confirmation email.

The order confirmation acknowledges receipt of your order but does not guarantee acceptance.

A contract between you and Meylt is formed when production of your order begins.

We reserve the right to refuse or cancel any order before production begins, including where:

payment cannot be authorised;
pricing errors have occurred;
fraud is suspected;
product information is inaccurate;
we are unable to fulfil the order.

Where payment has already been taken for a cancelled order, a full refund will be issued.

5. Pricing and payment

All prices displayed on the website are shown in the applicable currency selected by the customer.

Prices may be changed without notice.

Payment must be made in full at the time of ordering through our authorised payment provider.

We currently process payments using Stripe.

Ownership of products remains with Meylt until payment has been received in full.

6. Production and delivery

All products are produced to order in the United Kingdom.

Standard production and delivery times are typically between 3 and 5 working days.

Delivery timeframes are estimates only and are not guaranteed.

Where we anticipate delays beyond 7 working days, we will make reasonable efforts to notify you.

We shall not be liable for delays caused by:

courier services;
customs processes;
weather events;
industrial action;
supply chain disruption;
events beyond our reasonable control.

Risk in the goods passes to you upon delivery.

7. Cancellation rights

All products sold by Meylt are produced specifically in response to customer orders.

Under Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory right to cancel does not apply to goods made to the consumer's specifications or clearly personalised goods.

As production may begin shortly after an order is placed, orders cannot be cancelled once submitted.

Please ensure all selections and product choices are correct before completing your purchase.

Nothing in this section affects your statutory rights relating to defective or misdescribed goods.

8. Defective or damaged products

We take great care in producing and packaging all products.

If your order arrives damaged, defective or materially different from what was ordered, you must notify us within 7 days of delivery.

Claims should be submitted to:

We may require:

photographs of the issue;
photographs of packaging;
further information relating to the defect;
return of the product where reasonably required.

If we determine that a product is defective or has been supplied incorrectly, we will arrange a replacement at no additional cost.

Where we request return of a defective product, reasonable return postage costs will be reimbursed.

We reserve the right to reject claims where:

the issue results from misuse;
the issue results from accidental damage after delivery;
normal wear and tear is involved;
the claim is submitted outside the stated reporting period.

Replacement is the primary remedy offered under these Terms.

9. Intellectual property

All content on the website, including:

branding;
logos;
graphics;
website design;
text;
software;
product imagery;

is owned by or licensed to Meylt and is protected by intellectual property laws.

No content may be copied, reproduced, distributed or commercially exploited without prior written permission.

10. Artist content

Artwork displayed on the website remains the intellectual property of the relevant artist unless otherwise stated.

Artists grant Meylt permission to:

display artwork on the website;
market and promote artwork;
reproduce artwork for fulfilment purposes;
create and sell authorised printed reproductions.

Meylt reserves the right to review, reject, suspend or remove artwork at its sole discretion.

This may include artwork that:

infringes intellectual property rights;
is unlawful;
is offensive or defamatory;
breaches platform policies;
is otherwise considered unsuitable.

11. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
any rights that cannot be excluded under applicable law.

Subject to the above:

Meylt shall not be liable for indirect or consequential losses;
Meylt shall not be liable for loss of profits, business, revenue, goodwill or opportunity;
Meylt's total liability arising from any order shall not exceed the amount paid by the customer for that order.

12. Website availability

We aim to keep the website available at all times.

However, we do not guarantee uninterrupted access and may suspend, withdraw or restrict access for maintenance, upgrades, security reasons or operational requirements.

We shall not be liable for temporary unavailability of the website.

13. Force majeure

We shall not be responsible for any failure or delay in performing our obligations where caused by events beyond our reasonable control.

Such events include but are not limited to:

natural disasters;
fire;
flood;
epidemic or pandemic;
war;
terrorism;
civil unrest;
industrial disputes;
transportation failures;
utility outages;
governmental restrictions.

14. International orders

Meylt currently delivers within the United Kingdom.

We reserve the right to expand delivery territories in the future.

Additional terms, taxes, duties or shipping restrictions may apply to international orders where offered.
